01Is reservation governed by one identical rule across India?
No. Constitutional provisions establish the framework, while Central and State laws, notifications, lists and institution-specific rules determine implementation. Public employment and educational admissions also use different processes.
02Which constitutional provisions are most relevant?
Articles 14, 15 and 16 are central. Reservation-related enabling clauses include Articles 15(4), 15(5), 15(6), 16(4), 16(4A), 16(4B) and 16(6). Their exact wording, amendments and judicial interpretation matter.
03What is EWS reservation?
The 103rd Constitutional Amendment inserted Articles 15(6) and 16(6), enabling specified measures for economically weaker sections. The Supreme Court upheld the amendment by majority in Janhit Abhiyan in 2022. Applicable eligibility comes from current official rules.
04What does creamy layer mean?
In the OBC context, the doctrine seeks to exclude socially advanced sections from backward-class reservation. Its application depends on legal context and current government criteria; it should not be reduced to an unsourced income number.
05Does a lower category cut-off prove that standards have disappeared?
No single cut-off can prove that. Cut-offs depend on seats, applicant numbers, score distributions, preferences, rounds and category rules. Minimum competence, rank allocation and later performance are separate questions.
06Can economic criteria alone measure disadvantage?
Income is relevant but incomplete. Assets, family size, schooling, parental education, disability, geography and informal employment may also affect opportunity. A multidimensional system can improve targeting but must remain auditable and accessible.
07Is RHA asking people to target reserved-category citizens?
No. RHA rejects caste-directed hostility, humiliation, threats and collective blame. The platform advocates peaceful constitutional policy debate, transparent standards and strong support for genuine disadvantage.
08Is the RHA member card an official government identity card?
No. It is a voluntary community membership badge. It does not establish government identity, legal status, employment authority, educational eligibility or entitlement to any public benefit.
09How does RHA check research content?
Material legal and factual claims are checked by a human reviewer against cited sources. Digital and AI-assisted tools may support drafting or translation but do not publish automatically or act as expert authors.
10How can I challenge or correct an RHA article?
Use the public Corrections process and identify the exact passage, the problem and supporting evidence. Material factual corrections are reviewed independently of whether the requester agrees with RHA’s stated policy position.
